Window to Africa 2000 add-on tour

Please read the following terms and conditions. They limit our liability and outline the conditions under which your tour will operate.

Price

The tour price is in South African Rand (SAR/ R).

The price is calculated based on costs as on 1 January 2000. Should these costs change, a surcharge may be made on the price of your vacation. If the total tour price increases by more than 10% clients will have the right to cancel within 7 days of notification of the surcharge without penalty. Where payments have already been made to contracted service providers (such as, but not limited to-, hotels) their terms and conditions will determine whether any penalties will be payable to them. Should any of these service providers penalise us for cancelations such monies will be excluded from this guarentee. No refund will be made if costs are reduced.

Value Added Tax (VAT)

Prices exclude value-added tax (VAT) as foreigners (non-South Africans) who pay for their tours from non-South African funds are exempted from paying VAT. South Africans, however, will have to pay VAT as a surcharge on their full tour price.

Membership

Children are welcome provided they are accompanied by their parents. Where children are under 15 years of age this must be clearly stated.

Handicapped passengers are welcome on our tours, provided they are accompanied and do not require special assistance, as a certain amount of walking whilst sightseeing is a feature of all tours.

Exclusions

We reserve the right to withdraw tour membership from anyone who's behaviour is deemed likely to affect the smooth operation of the tour, or to adversely affect the enjoyment or safety of other clients, and we shall be under no liability to any such person.

Itinerary variations

We constantly strive to improve tour intineraries and features. If such improvements can be made, or if circumstances beyond our control make changes necessary, we reserve the right to vary itineraries and to substitute hotels and/or other accommodation.

Cancellation

We reserve the right to cancel or reschedule any tour departure in accordance with operating requirements or circumstances beyond our control. Should this occur, we will offer you an alternative arrangement. If there is a difference in cost it will be for your account. If you do not accept this alternative arrangement within 7 days, we may treat this contract as terminated. We will refund all monies and will then be under no further liability. WE ARE NOT RESPONSIBLE FOR THE COSTS OF ANY OTHER TRAVEL ARRANGEMENTS AFFECTED DUE TO OUR CANCELLATIONS.

What is not included in price

Air fares to and from South Africa*; airport taxes; passport and visa fees; insurance; laundry; phone calls; beverages; room service; meals not detailed in the itinerary*; tips to tour guides, motorcoach drivers, local city guides and porters; items of a personal nature; excess baggage; optional excursions*.

Payment may be made in any currency acceptable to South African banks but must be equal in value to the South African Rand amount specified as price for this tour.

Deposit
A 25% deposit per person per tour 65 days prior to departure date. (*in the case of the sugarcraft tour we are wavering this requirement due to communication problems with potential clients, you can pay your deposit separately if you wish or together with the final payment as set out below).

Final payment
45 days prior to departure date (*i.e. 31 August 2000).

1. Your land reservation will be confirmed on receipt of deposit.
2. Full payment is required at time of booking for reservations made less than 45 days before departure.
3. We reserve the right to cancel the reservation and apply cancellation charges should payments not be received within the specified periods.
4. All monies received by us will be deposited. We will be entitled to keep for each account any interest earned on such monies. It is a condition of our confirmation of your booking and acceptance of your deposit that all monies paid by you to us in respect of your tour, whether by way of deposit or otherwise, be disbursed by us as and when we see fit or in respect of the services to be provided or fees payable under the tour programme. The payment of a deposit or otherwise for your tour shall be deemed to be a direction to disburse such monies as aforesaid.
5. You will receive travel instructions (pre-tour documentation*) for your tour in Southern Africa approximately 21 days before departure (provided full payment has been received)

Cancellations, refunds & booking charges

1. Notice of cancellation must be made in writing directly to us.
2. The following scale of charges will apply when cancellation is notified:

Where applicable these cancellation fees are in addition to any cancellation fees that may be levied by your travel agent.

Hotel & Other Accommodation
Hotel & other accommodation cancelled within 31 days of your stay incurs a 100% cancellation charge.

Illness or absenteeism
In case you have to withdraw from a tour after it has begun for reasons such as illness, be sure to obtain a medical certificate in support of any insurance claim. We regret that we are not able to make refunds for absences from a tour, including but not limited to missed nights and sightseeing. If a promotional airfare is interrupted or extended for any reason, an additional fare may be payable.

Africa Deluxe Tours cc*, is henceforth referred to as "the Operators". The Operators undertake the following duties:

1. The Operators shall be responsible to the client for supplying the services and accommodations described on this web site, except where such services cannot be supplied or the itinerary* is changed due to delays or other causes of whatever kind or nature beyond the control of the Operators. In such circumstances the Operators will do their best to supply comparable services, accommodations and itineraries and there shall be no refund.
2. The information on this site, represents the entire agreement between the passenger and the Operators.
3. In the absence of their own negligence, neither the Operators nor their agents or co-operating organisations shall be responsible for any cancellations, delays, diversions or substitution of equipment or any act or omission whatsoever by air carriers, hotels, transportation companies, or any other persons providing any of the services and accommodation to passengers, including any results thereof, such as changes in services or accommodations necessitated by the same. Nor shall the Operator be liable for any loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, or negligence of any person not its direct employee or under its exclusive control. The Operators are not responsible for any criminal conduct by third parties.
4. Where the passenger occupies a motorcoach/ vehicle seat fitted with a safety belt, neither the Operators nor their agents or co-operating organisations will be liable for any injury, illness or death or for any damages or claims whatsoever arising from any accident or incident if the safety belt is not worn at the time of such accident or incident.
5. Transportation companies, airlines, etc. will not be held responsible for any act, omission or event during the time passengers are not on board planes or transportation conveyances. The passenger contracts in use by the airlines or transportation companies or contracted operator when used shall constitute the sole contract between the airline, transportation company, contracted operator and passenger or purchaser of this tour. The Operators assume no responsibility in this regard. Enrolment in and payment for a tour shall constitute agreement and acceptance by the passenger of the terms and conditions set forth on this web page which cannot be varied except in writing by an duly authorised officer of the company.
6. All matters concerning this booking shall be subject to the laws of South Africa* and legal action arising under the contract shall be litigated only in the appropriate court having jurisdiction in that country, which court both parties acknowledge to have exclusive jurisdiction in relation to any legal action brought here-under.
7. Every effort is made to ensure the accuracy of this web site; however Africa Deluxe Tours cc* cannot be held responsible for errors arising from unforeseen circumstances.
